Who Had The Right-of-way? The Huge Gaggle Of Motorcyclists, Or Our Vehicle? (details Below...)

Postby Comyn » Sun Feb 09, 2014 4:04 pm

We're at a red light, waiting to make a left turn. It's a very busy intersection on all 4 sides. The traffic going across the road in front of us is mostly motorcyclists(50+) ... Obviously there is some event going on in our area but it is not a holiday(like Veteran's Day or Memorial Day, when one would expect such an event), it is not a parade, and it is not a funeral. There are *NO POLICE ESCORTS* Our light turns green. Their light, obviously, turns red... We move forward. The motorcyclists continue to pour across the intersection and start screaming at *us* to let them through. We could have killed them or gotten killed ourselves. Other cars behind us started to move forward, too. The intersection was a mess of the motorcyclists continuing to try to get through on OUR green light, almost getting hit by cars. Traffic backed up.Who had the right-of-way? Is there some law or unspoken rule that you let them all stick together even if they don't have a police escort?

Sure, mr Tee may have had the theoretical right to the intersection, but it would be asinine and unsafe to move your car into the face of a flow of hundreds of bikers.Drivers are supposed to be situationally aware and make smart decisions. Just because the bikers were idiots doesn't give Mr. Tee license to be as well. 55 months ago

laws, especially traffic control devices.  I personally would have made my left turn, into the middle of them, and then let the police sort it out after they healed.  *YOU* had the right of way by benefit of the green light.  Next time, if you have the right of way, take it.

I am Mrs. Tee, actually - LOL.Yeah - I didn't want to know if I had the right to plow the people down, I just wanted to know what they were thinking and if there was something I didn't know regarding motorcycle law that would allow them to do this. Of course, no matter who is running a red light, I'm not going to challenge them, at the very least, for my own safety.

Unless it is some kind of organised procession, with a police escort for traffic control, they must obey all traffic laws, especially traffic control devices.  I personally would have made my left turn, into the middle of them, and then let the police sort it out after they healed.  *YOU* had the right of way by benefit of the green light.  Next time, if you have the right of way, take it.   Schelli's Recommendations Passing the Driving Test For Dummies(For Dummies(Sports & Hobbies)) Amazon List Price: $21.50 Auto Roadside Survival Guide to Dummies(For Dummies(Computer/Tech)) Amazon List Price: $9.99 Used from: $3.00 Schelli 55 months ago Please sign in to give a compliment. However, having the right of way isn't an enforceable right like a right to inherit something.   Rule number one is real simple:  Don't hit nuthin'!   Even though the motorcyclists were acting like prime jerks, you still weren't allowed to take any action to put them in an even greater danger than what they have already put themselves into.   I hope that someone called the police, since if they keep driving that way, others will wind up endangered as well. It is moments like this that cell phone cameras are made for.   As someone I know describes another motorcycle club,   "They're mostly people whose only accomplishment in life has been to learn to ride a Harley without falling off and breaking their plumb fool necks."     Here is an artistic rendering of one of the species.     www.mrtoys.com/department-56/pics/Guillermo-Forchino-The-Biker.jpg

This is a time when the law takes second place Frankly, you're tilting at windmills.  It's a non-issue.   It really doesn't matter who had the legal right of way.  For whatever reason the situation was beyond the scope of the law.  The cyclists were pouring across the intersection without respect for the light.  Fine. SO deal with the situation, and wait.  In this case, right or wrong takes a back seat to safety.   Suppose you had said "it's my god given right to cut across that oncoming traffic(50 mph) and therefore you cut them off.  You might feel good and authorized, because the law was on your side, but you would have multiple dents and collison marks on your car, and several people would be in the hospital, including you.   So don't fulminate on who is theoretically right or wrong, but instead, deal with the situation.  Your blood pressure will be lower and you will be more well adjusted.
