Will I get my rent deposit back?

Postby ryscford » Sun Feb 26, 2012 6:07 am

a new realty company took over management of the house I rent. the realtor for the new company said that our rental agreement with the old company has "rolled over" to them so I don't need to sign anything new. is this true? I'm afraid that since I gave my security deposit to the old realty company I will not get my deposit back when I leave, or even worse the new company will sue me for the security deposit and claim they never got it. Is there anything else negative that may happen to me when I leave the property because I did not sign a new contract with the new realty company?

Leases survive ownership changes. The new owner assumes all responsibility for the old landlord including the escrow of your security deposit and is subject to the same state laws regarding its refund. Hopefully you have kept your copy of the original signed lease and have it in a safe place in case it needs to be shown to a third party (like a small claims court judge)
