Would a writ of recovery issed by the court INCLUDE all their belongings?

Postby alleyne » Sun Dec 18, 2011 2:03 am

Im evicting some tenants out of my basement. Im not a 'real' landlord but state law requires I follow proceeder..that's fine. But it leaves me with with lots of questions. lol . The judge and I gave them 30 days to evacuate and it's up in 10 days! No sign of them leaving! What if they leave last minute and leave all their furniture for example? Do I have to hold it or does the WRIT mean them AND their belongings must be OUT by the date.

It means they must remove anything they have in the property, but if they do not you will have to store it and allow them time to get it, they will have to pay the storage and if they have not claimed it in 30 days you can sell it to cover the storage.
