Wrong Sized Screw

My brother recently fell at work and fractured his medial condyle. Ortho placed a screw, and post op developed numbness and pain, felt like something was "hard"...this is 3 weeks ago. Cast came off and X-ray done showing screw went through medial condyle and palpable on other side. Arm still numb and painful, Doctor's attitude different after he saw the X-ray and now reccomending physical therapy apparently hoping improves. Any legal recourse?

Jay,

It sounds like there is potential malpractice for the physician to insert the wrong size screw.  However,  it is unlikely a qualified medical malpractice attorney will take the case without permanent injuries.
