Septoplasty Gone Wrong

I had a septoplasty on 15 Jan 09 to fix a deviated septum. 1 week after surgery, this splints in my nose tore open the incision and I was re admitted because no one could get the bleeding under control. After release I noticed that the septum up front looked like it had popped out. The Dr. said it would heal a month later it was worse, he put me on antibiotics and again said it was fine. In march I went in to ENT because I couldnt breath at all out of my nose and he looked at it and said the septum is now worse than before the surgery and he would have to go back in to fix it. He called me the next day and stated that he knew something was wrong after the surgery because when he was closing up the incsion a piece of cartilage popped out of the septum up front and so he went back in and cut it off and the closed up. He said that he had been placating me the last 3 months and knew there was a problem. The next surgery is on the 15th of April 09. My problem is that this is a military ENT, Im not active duty, my spouse is. Im a dependent. Say this second surgery goes wrong do i have any sort of case here since he has made the nose worse than when we started and this was an elective surgery?

You may have a case, but this doctor, while a bit chicken, has told you the truth. Are you certain you want him to do the corrective surgery?

Cases like this one are difficult for a lawyer because you do not mention any loss of income. Discomfort and pain, yes. But a lawyer can sue for money only. Talk to a couple of malpractice lawyers and get their reaction.
