Am I at fault?!??! PLEASE HELP?

Postby darrell » Wed May 30, 2012 9:10 am

i already asked this question but i got a lot of rude answers so im gonna ask again but add a lot more details...PLEASE HELP! and dont be an a s s h o l e about it. Oh, and dont say i cant drive because i've been driving for 3 years with one ticket and no accidents.

I just want to know who YOU GUYS think is at fault. Okay so I was driving down a two lane divided highway (one of those ones with an extra curb lane for right turns and stuff) in the farthest right lane (closest to the curb) BECAUSE I WAS GOING TO TURN RIGHT AT THE NEXT STREET. I guess the other two actual lanes both LEFT A GAP TO BE COURTEOUS and let a car turn left from the opposite direction. (YOU KNOW HOW PEOPLE LEAVE SPACE AT SIDE SIDE STREETS IN CASE AMBULANCES OR SOMETHING COMES? YEA THATS WHAT THEY DID FOR HER) I didn't see her BECAUSE THE OTHER TWO LANES HAD TRUCKS AND S H I T IN THEM (AND MY CAR IS SUPER SMALL AND LOW TO THE GROUND) and I was still moving in this third lane. So she keeps going and I HIT the back PANEL of her car (NOT LIKE WHERE THE TRUNK IS, BUT WHERE THE TIRE IS). My car ended up being totaled--airbags deployed and even TURNED COMPLETELY AROUND. Was it my fault? Or hers? oh and I got a ticket for speeding if that matters (THE SPEED LIMIT WAS LIKE 30 AND I WAS DOING 40)

The stuff in all caps is the extra details lol. thanks for your help...

guess you can't say you've never been in an accident now. lol.. bummer dude. but they happen...thats why we get insurance right.. ok so..
IF the intersection had a light, and that light was red, then it was your fault.
If the light was green, or there was no light and the road you were on was just a straight through and you were just turning off of it, then it's her fault for pulling out infront of a car. A left hand turning car doesn't have the right of way with the exception of advanced turn lights, and clearing an intersection after the lights turn red..

argument can be made that you should have been looking out though and that you are in part responsible for the accident as you were going too fast for the conditions to stop quickly...

sounds like 60 or 70% her fault,

With added detail... my answer still applies
She can't turn left infront of oncoming traffic.. no matter how fast it's going...
You were going too fast for conditions. split fault.
