I have been trying to get custody of my daughter since may and the judge keeps turning us down making up excuses why. Is it the judge and is there any law saying that after a certain amount of months i automatically get her? or any law that will help?

The standard in New York for custody of a child is what's in the best interest of the child. So, the question becomes what will make the judge decide that it is better for the child to live with you than somewhere else - wherever she's now living.

There's no time limit - as long as the child is a minor, she is under the jurisdiction of the Family Court.

Nothing is automatic e. The judge decides on custody based on hwhat he or she decides the evidence proves. It's what they finf is in the best interest of the child. At the age of 14, the wishs of the child play a part as well.

Good LUck

I don't know about NY but I know in the southwestern states it takes an act of congress it seems to move these people.
Everyone gets an attorney and fights and squabbles and when it comes to spliting the child in two before they make a decision.
You have my deepest sympathy it is long, flustrateing and painful.
Eventually it does happen. Children I know want to be with their parents.
