Anyone have any case law on parole keeping felon from family?

Postby ardwyad » Wed Nov 23, 2011 9:57 pm

We've seen cases where parole has kept a person from their own family. Does anyone know where we can get some case law in favor of family rights? If you are one of those who believe parole can do anything please don't bother responding. We have seen cases were courts ruled in favor of sex offenders being allowed to live with their families. It seems parole does a lot of things against the constitution and either the parolee puts up with it or when they get close to a court date, parole will give in and then there will be no court record for others to rely on. Thanks.

Parole has a purpose: to supervise someone and to see if they can reinegrate into society. As a convicted criminal, you have NO special rights that non-convicts have. In fact, you can be thrown back into jail at any time if you don't like it. You are still sentenced, though you are allowed to finish that sentence within society.

So stop whining. You can visit your family as long as you don't leave the jurisdiction, and as long as there are no restraining orders in place. If you have a child, you must have custody rights, which could be stripped away if you commit a crime.

People do not have a right to live with their families. The courts have continuously upheld sex offender residency restrictions as constitutional protections, which is what I assume you are talking about. If the family wants to move to live with the parolee, they are free to do so. But if a sex offender parolee wants to live with a family member who lives in an area where he is not allowed to be because of his sex offender status, then the courts will not allow him to live there.

No.

Parole doesn't do anything against the Constitution. The Constitution says that your rights cannot be infringed upon by the government until there's been due process. You know that whole court thing that happened before the person got sent to jail? That's due process. The government has the right to put all kinds of restrictions on your life if you've shown that you can't play by our rules.

A felony is a serious crime. It doesn't just happen. People that commit felonies know they're breaking the law, and they're effectively telling society "I don't give a s*** about your rules." Well, you can't blame society when society reacts negatively to being treated like that.
