If you owe past taxes on your home and there has been a sale of a tax certificate, can that be included in a chapter 13 bankruptcy without losing your home?

Bankruptcy law is overwhelmingly a federal process. However, the federal government does generally allow each state to determine what property is exempt. Some are quite generous. Others exempt very little.

I hope that you're not planning on filing this yourself without the benefit of an attorney. There are a lot of pitfalls in the modern bankruptcy practice, and if you mess something up you may end up spending thousands of dollars to pay an attorney to fix it.

Contact a licensed bankruptcy attorney in the State of New Jersey for specific exemptions under New Jersey law. For a referral, contact your local or state bar association.
