Are All Debt Collectors Pains in The Rear?

Okay here is the scenerio....My mother died last August 27, 2006--almost a whole year ago. Now when a person dies, whatever money that person owed or had debts to a company, especially like credit cards terminates with them....By law, survivors aren't obligated to pay those debts...unless of course whatever debt it was, say a loan, etc was a joint account. When my mother died, I did cover letters, filled out forms and sent copies of my mother's death certificate to each and every place my mother had debts too. So you would think that's that, right? No siree. Wrong-o. So here my mother's gone almost a year, and I'm still being hounded by some of these debt collectors, including the jerks at the hospital where she died. Early on, when she first died, I sent a copy of her death certificate which in a way was dumb, as this was the hospital...so of course it was on record she had died. A month after she died, I get a call from these jerks, and even she said I wasn't obligated to pay the bill....oh, sure like I could cough over, over $6 grand at a blink of an eye...NOT...So this person says, send a copy of the death certificate..Like duh? I already did that,but sent another one out anyway...another month passes by...same thing..Same woman, and she says we're still waiting for the death certificate..I sent it, I sent it , I sent it...But send another one anyway--Long story short..I'm still being bugged by not only these people but other collection agencies. Like what the he!! does it take to get these people off my backs already, almost a whole year afterwards? I'm thinking, gee, maybe I should go to the hospital to their billing/payment office. Say whoever is there, my mother would like to pay her long over-due hospital bill. Here she is...and present them with the jar with my mother's cremated remains....or how about this, suggest we hold a seance so she can pay the bill Has anyone else gone through this aggravation when a person dies, and is hounded by collection agency for debts that aren't your responsibility to pay??

That is horrible, pyewacket. Ugh, those debt collectors are a scroungy bunch. I have not had that situation happen to me(my brother handled everything relating to my mother's death), but I do know a thing or two about bill collectors. On the occasions where they have hounded me I found it very effective to just go postal on them. I know that they're just doing their job, but, I draw the line at calling me every day.

That's just it...I've written letters to these jerks too...but still get the calls anyway--you'd think it'd be better somehow in writing...NOT

I feel for you friend. I would love to see you walk in there with your ideas. If it were me, I'd cut a copy of the death certificate in to puzzle pieces, and hand them out to the people working in the billing department, if they were smart eough to put it together, it would read, "GET AN F-ING CLUE"

No I haven't had that issue yet because someone has died. You could send it and make it so that they have to sign for the mail so you have proof you sent it... but that is just so silly how many times do you have to tell them and send the certificate stating she is know longer here and able to give them what they want lol. I feel for you on this one pyewacket collectors can be a really pain in the behind. I still get called about my ex at its been almost 8 years since we were divorced lol. They still call me and ask were he is and all that crap... I'm like NO and I don't want to ... I don't need that can of worms reopen thanks... My kids are happy and safe right now and that's all that matters to me. I've even had to change my phone number and make it private because they would keep hounding me about him lol... They just want the money that's all they care about... plus usually the people collecting only make their money buy how much they have managed to collect off the people on their list. I just wish they would stop being so rude, nastey and pushy!related resource: managed care

Too bad I just can't plain sue for harassment...or least make the suggestion to ..but then they have big lawyers backing them up

True But in away it is harassment. Specially when you add up all the calls you get and the amount of times you have to remail out the information. I'm not sure what the laws are in the states for collections but here I keep a record of that crap now and have reported a few of the agencies and they stopped bugging me... Except then I just get new ones picking on me instead lol.. Thats why I gave up and change all my stuff lol cut down on my harassment and constant reminders... sueing would be really nice if it was an option lol... they would back off in a hurry I think if you were able to lol. I guess all I can say is good luck and hopefully they hint soon... or the seance idea might be your only option left, since they probably wouldn't except the ashes since they couldn't prove it was still her by photo ID ...ROFL

There are a few things you can do. When they call are they asking for your mother? Simply say you're sorry she doesn't live her. Read up on the Fair Debt Collection Act. I believe if you notify these companies in writting they are not longer allowed to contact you. Again read up on this Act. It should tell you how to report these companies. You said you already send cover letters, you by rights can just report then out right with out sending another letter. Read up on this Act. A friend of mine did and she has been harrassement free for months. Different situation, but death should be covered under that protective act too. Best of luck to you.
