Can i pursue the local council for personal injury on these grounds?

Sometime ago a new neighbour moved into the flat nextdoor , basically for what ever reason there began a disgusting smell of faeces and urine . For over a year i have written to the council and their enviromental health dept but they have failed to address the issue . Then situation is that the smell has started to seep into my home and that the communal foyer smells so bad one is almost vomiting on either entry or departure . Recently i have been prescribed antidepressants as it was getting me down .

Is this equal to that of personal injury ?
Can i pursue the council ?
How do i do it?

This is a health hazard simple as that. Therefore you must inform the council that you will contact local radio and the newspapers and local TV - you dont have to - just threaten to do it.
The Council, as Landlords, are directly responsible when health is an issue. You should tell them you have contacted a "legal adviser" (me, so you are not lying) You are not responsible for other peoples dogs or cats, that is their problem. But you do have a right to be free from their smells and possible infection - rats - mice - etc.
The fact they have "deep cleansed" and "moved her" in the past is a clear acceptance by the Council of the problem.
You can claim against the council but you must see a doctor and get this on record also the doctor may help you with regard the Council.

Complain directly to one of the Councillors for your area. Get your neighbour to do the same. Complaints from elected members get priority over almost everything else.

I am concerned about the poor animals and would suggest you get the RSPCA to do an assessment.

One further point - check that the Council are directly the landlords - a lot of them use arms length housing Corporations

If it is as bad as you say in the foyer what about the other people in the block, they
must have the same problem. I presume you are a council tenant is this right?
