Can she really press charged for filing a false police report?

Postby eochaidh94 » Fri Apr 08, 2011 2:25 am

On Friday, my ex and his sibling kept driving past my home and bowling a whistle. This was not the first incident of their childish games but the first I reported. I called the local police department and they asked for my telephone number but not my name. They advised me they would speak with them and tell them to stop. The police did not file a police report but a 'call card'. I was advised by another friend last night that the spouse of my exes sibling is planning on filing charged against the person who called on her spouse and brother in law for making a false police report and was waiting for the local police to trace the call. She works for a personal injury lawyer as a paralegal. I called the local police again to see if this could be true and they stated it was a civil matter. Can this really happen? Can she press charges against me for making a false police report when I DID NOT? I did nothing wrong!

this is more than just a little complicated --- and so you need to seek legal advice --- but in the mean time --- if they are " harrassing " you as you state , then you go down the station and get an order taken out on him -- provided you can proove the grounds --- but my issue with this when you made the complaint --- it waasn't followed up --- an occurence sheet is something every police person has to follow up on when the phone , etc has been made --- somethings not right here --- good luck

That's ridiculous! A false police report is not a civil matter, it's a criminal offence. Don't worry about it, they're just trying to scare you.

Unless 'she' is the DA, 'she' can't file charges for filing a false police report. She can file a complaint, and the DA can decide if charges are justified.

You state the police told you it was a CIVIL matter. By definition, that means CHARGES are not being filed. If she actually works for a lawyer, she KNOWS that even if she sued, she has absolutely no case. She also ALREADY knows you made the call and WANTED you to hear they were talking about suing. Don't participate in hear mind games.

PS: The police wouldn't have to 'trace' the call. They knew where it was from BEFORE they asked you to CONFIRM your phone number.

1) if they did it it is not a false report. What the idiot told his wife is something else. There is no charger she can file for filing a false report. Only the police can file charges for filing a false report.

"it is a civil matter" means the police are not involved since they only handler "criminal matters" She is smoking you. She can not even file a tort suit since he was not injured. All she can do is file a protective order. And that won't work either. keep calling the cops when they do this stuff. When it escalates ask the police for copies of the call cards and file for your own protective order.

Oh yeah keep tack of all this stuff too.
