Could I have a Malpractice case against a hospital for doing horrible surgery on my hand?

A little over 6 years ago a local hospital did surgery on my hand after I broke my hand in a sports accident in high school. The surgery was so bad the first time that they had to do it again. While doing this second surgery the bone doctor removed 1 section of bone out of a 3 piece fracture which caused my knuckle to recede greatly and give my hand the appearance of being slightly deformed. My ring knuckle wont extend passed my pinky knuckle. My hand hurts every day and I can barely make a fist these days. Does any one think I could have a case against this hospital even after all these years due to the doctor removing bone without my consent and proprietorially making my hand crippled to this day?

All jurisdictions have a limit of time by which you must bring a medical malpractice action. Most are 1 year from the time you knew of the malpractice or injury to three years after the incident, unless dissuaded by the medical professional or provided false information as to the injury. Sounds like you waited much too long to see legal advice.

With that said, it is still possible that no malpractice occurred. Not all medical conditions and surgery turn out well.

Depending on the state where you live you may be out of luck due to the statute of limitations. In many states it is 2 years from the act of malpractice. However, you might be able to squeeze in by arguing that you were not aware of the malpractice until your hand started giving you so much trouble You should contact a medical malpractice attorney in your area asap and get his or her opinion.
