Custody, divorce and family laws in Oregon. ?

A woman in her mid 30's has two children under 8 and is married to an illegal immigrant. They are filling for divorce and the women and children are U.S citizens. He says he is going to get custody and take the kids to Mexico. My question is, since he is not a citizen or have a visa or anything allowing him to be in the states legally, does he have any rights at all to anything? In a court of law will he be granted custody or anything else? He is claiming that the women kicked him out of the home, which is not true he left on his own, there are police records of him physically hurting a minor, he has tried to band the womens children from a previous marriage from being allowed in the home or around period, he has been caught and admitted to cheating for more than half the marriage, claims the house is unfit for children because there are toys out, dirty laundry in the laundry room, dirty dishes in the sink and things that I would say are normal for a home with 5 children living in? He has physically abused children and the women, mentally abused both and is nothing more than a bully, but says because the mother suffers from depression and bi polar, which are both being medically treated by a dr, that she will automatically lose her kids? The mother has been fearful of her life, and her kids life's, and afraid of going them if she left, but has finally had enough and wants out, what advice could you give me to pass along?

He can't do that and it has nothing to do with oregon law. If she married him, he is a legal citizen after 2 years of marriage. He can't get custody if he chooses to go back where he came from. Get your own divorce attorney. If you are already filing and have an attorney, then it is a piss poor one if you need legal advice here.
