Do we have to give a 30 day notice?

Postby ern » Thu Aug 02, 2012 11:07 am

My Fiance and I have been living with a friend/room-mate for quite some time. Things are simply not working out and 7 weeks ago my fiance had a sit down with said room-mate and let him know that he had until August 1st to move out (which gave him a month and a half). Our room-mate agreed and we carried on with our lives. It is now the 31st of July and my Fiance brought up the move with our room-mate to basically check on the status of everything, our room-mate said that we were being unfair and that he wanted a 30 written notice and that its required by law. He agreed almost two months ago on this date and he is not our tenant! Do we have to give him 30 more days and put up his crap? We live in the state of Idaho if that makes any difference.

Thank you very much for answering, as we really could use some guidance.

Do we have to give a 30 day notice?

he isn't your tenant, he is your roommate. the first thing to know is if there is a lease and if he is one of the sighners on it?
if you want him to move out, you can ask him, but you can't make him since he isn't your tenant and is a co inhabitant of this dwelling. alternatively, the two of you can move out if you are unhappy living with this person.
if this roommate is willing to move and leave you with the place...as long as he isn't a signer on any lease, you need to give him the 30 day written notice or pick an alternative. im not saying it is the law in this situation, but it would settle the problem and its only another month if you give it to him by tomorrow...(last day of july) otherwise it will be two more months.

He isn't your landlord. Ignore him, he is an idiot.

He is not a tenant. You dont owe him any legal notice in writing. You never had any agreement verbal or written about his tenancy. Tell him he will get no more notice since he is not a tenant and he is trespassing. If he has no proof that he is a tenant, he is considered a guest. If that wont work, post a 3-day notice on the door. You should also give him a 30-day notice at the same time, and mail it certified to him at your place.
