In New York do I have to give 30 days notice?

I rent a mobile home in New York. I did sign a rental agreement, it is month-to-month. The lease does not say whether I have to give 30 days or not, but I didn't know if there was a law in Ny or anything so I wanted to check before I did anything.

My landlord has gone back on things she has said and changed the rules a few times and I have only lived here since May 12th. I want to move out and find a new place by July if I can, but I didn't know if I need to give her 30 days notice.

NY is weird with this. In NYC...you do not have to give a 30 day notice, but in NYS (outside of the city) the laws require that you do give a 30 day notice...in writing. Since you are a month to month tenant, giving notice now will still make you liable for the full month of July.

be the "bigger man"--give the notice in writing.

too much is way better than too little.

leases do not have to put all parts of the law in them; the lease
would be 12 pages long.....[grin] [the law is the law whether in
the lease or not]

You have to give 30 days notice if it is not in the lease, you go by state law. Only in New York City you dont have to give any notice. Every state has a law covering notice to vacate and it must be written. You give notice the 1st of the month and leave the last day of the month.

30 days should be satisfactory, after all the State if New York can have quirky laws.
