Does an employer have to carry unemployment insurance?

Postby tonibraxton » Fri Jun 15, 2012 5:57 pm

I recently accepted a job with a company , and he stated he wanted to hire me in as a sub-contractor,and pay me a percentage per job. I filled out a form so that he can write me off on his taxes. What I want to know is does he still have to pay into unemployment insurance, and workers compensation. If things get slow am I going to be able to file a claim, and if I should happen to get hurt can I file workers comp claim even though I am a sub-contractor.

He wants to treat you as an independent contractor.

Independent Contractors are not eligible for Unemployment or Workers Compensation.

Depends on state rules. If you are a contractor usually not.

No, not if you are a contracted worker. No unemployment, no WC, no State Disability.
