The NY regulation of intestate submission claims if no surviving partner, along with a kid, anything within the estate would go to the child.  Nevertheless an IRA or 401k doesn't feel the property, but moves straight to the called beneficiary.  Similarly a POD(due on death) consideration or trust bill doesn't feel the estate.
