What is the New York State Law for this situation?

My grandmother and aunt were driving down the road and a tree snapped and fell on their car. Now it ruined the windshield and dented the hood really bad. No one got hurt but it was about an inch away from my aunts face if she wouldn't have slammed on her breaks the tree would have landed on the roof and smashed it in completely and they probably wouldn't be here. So my grandmother found the number for the land owner.
The land owner is A LAWYER and he got very nasty with her saying it wasn't his problem.
Will he have to pay for my grandma's car? or will he get away with it?
I think he should have to pay because he neglected too take care of his property.

She needs to report this accident to HER insurance company. They will fight the landowner, but it will likely be ruled an act of god.
