Eviction law in upstate NY?

Postby kendrix » Mon Nov 08, 2004 12:03 am

I heard it is faster to get a tenant evicted in upstate NY, compared to NYC. Is that true? And if so, why is it faster? Eviction is a state law or local county law?

Eviction law in upstate NY?

Evictions are done through county jurisdictions. They can move as fast as a landlord can serve the notices and get a court date.

Once he gets the order from the court that tells you when you have to move, it's up to him to get the sheriff's department scheduled in case you don't voluntarily move.

Some landlords don't do the required things quickly, others don't waste any time.

I have evicted tenants in as little as 45 days from the first 3 day notice to pay or quit.

Yes it's true. NYC has additional laws that don't apply to th rest of the state.
