How does this eviction process go ?

Postby nickson » Mon Oct 31, 2011 6:07 pm

So pretty much I got a Affidavit for Summons of Dispossessory today, due to me being late on rent and etc. court cost and my included rent cost 1,700. I was going to use my financial aid refund to pay it all off in June, but I haven't received an award letter for the summer yet.. my neighborhood is off campus housing for students (I live in a college town) and they allow you to submit a copy of your financial aid award and rent is deffered until you receive a refund ..but the affidavit stated that I have by the 20th to answer the claim or vacate the premise. I responded online at ncourt.com where it told me to on the affidavit..I admitted to the claim of the plantiff, and requested a payment plan, but does this mean I'm getting kicked out on the 20th if I don't pay in full ?.I spoke with my dad and he told me that he can't help because he has to pay off his property taxes, so pretty much my own gurantor can't even help me. It's not like I'm depending on him..I'm willing to pay it all off, but I'm doing it by myself. I'm not like the other students in my neighborhood who have parents that actually support them..I buy my own groceries, pay my own car payment, and insurance, but I just need a payment plan...I'm not using it as an excuse or trying to justify anything..from all view points I was wrong for not paying it..Will I get evicted on the 20th or do I have to wait for an actual court date ? Because I'm currently in school now and I only have 3 weeks left and finals are coming up..

You cannot generally be "evicted" physically from any rental unit without a final court order, after having an opportunity to be "heard" (which you may have waived by admissions), and making any counterclaims and appeals. You really need to work out something with the landlord, even if it's just to decide what is the last day you can still be there without having your stuff thrown into the street and being arrested as a trespasser.
