Hello, This question is about workers comp in NYS?

Postby chay » Wed Oct 26, 2011 12:17 am

I had a meniscus tear around two years ago. The case closed and I received compensation. I did not settle, but the case was closed. Around 3 days ago My knee started swelling up and now it is unable to bend again. The physician did two surgeries so far. One to repair the meniscus and the other to check to see if it was healing correctly. Are able to reopen the case and if so will workers comp pay for the doctors as well as further compensate me since I most likely will have to have the meniscus removed and I once again am missing out on work? I just got my job and finally am able to be financially alright and now this happens. Thanks in advance for any answers to this.

HUH? Is this a new job with a new company or the same job you had when you were originally injured?

You state your case was closed and received compensation, so maybe not able to reopen this.

My suggestion is to post this question under Insurance since there are a lot of WC adjusters out there that may give you some info.

Also, if you had a lawyer handling this before, call them up and pose the question, since they will know NY WC laws and also the SOL (statute of limitations). If not, then I suggest you make an appointment to talk to a NY WC lawyer to find out your rights. Most good lawyers will give you 1 free consult to see if you have a case or not.

good luck
