I need help with a workers comp question about my business?

Ok, so my company is subject to mandatory workers’ compensation laws in MN the state in which it does business. My employee work as part of a crew that travels to remote locations to repair downed power lines and other damaged equipment. At a distant site, my other employee was injured in an accident that is entirely the other employees fault. He files a claim for workers’ compensation. Should the claim be granted by my business? What would be my best defense against it?

For starters, if you’re in the construction industry and have one or more employees, Florida laws require you to carry workers’ compensation coverage.
The only exception to this rule is if you are an exempted corporate officer or member of a limited liability company.
While this is a brief overview of the laws regarding Florida’s workers’ compensation policies, it’s not always cut and dry and there can certainly be gray areas within.
For example, landscaping businesses fall under the construction guidelines, where lawn mowing employers do not.
