In April A guy threw a beer can at me. It was uncalled for and him being stupid."he didn't mean to throw ir that hard and didn't think it would hit me " - he says. It hit me so hard my forehead was swollen to the size of a softball. I ended up going to the ER and had a concussion, bleeding, and swelling in my brain. From April until June, I had about 20 dr appts, MRI's, etc. Paying co pays outta my wazoo! The guy said sorry and left it at that. I asked to help pay my medical bills and he never replied to me. I have had massive migraines since April and had to quit my job in june because I could NOT get them under control. I didn't get them under Control until Aug and found a job. I am in debt because of him and been think ab out what to do for awhile.Can I sue for lost wages and negligenst due to my brain injury? Should I get a lawyer, or a civil suit at the court house???

Something like this you need a lawyer. It will far exceed the limit for small claims.

If you have the bills, initial hospital statement, and a witness, you don't need an attorney, unless your complaint exceeds the small claims court limits so sue bit by bit. It is expensive to file maybe you will qualify for a fee waiver. Also look at victims compensation rights and you may find a low cost attorney. I do hope the best for you. Don't let that idiot get away, sue him.

You can sue, and if everything you say is true, you will probably win.

COLLECTING is the hard part, win all you want, but if he has nothing you get nothing.

The court does not collect for you, they merely give you the judgment that allows you to collect.

Any time you think you need to sue someone, consult your attorney.

In personal injury cases, ask your attorney to take the case on contingency. That means that you do not pay the attorney. She gets paid only after she wins the case and collects the money from the defendant.

Note: If an attorney does not offer a contingency contract, it means that she does not believe that you can win the case, or that the defendant does not have sufficient assets to satisfy the anticipated judgment. If three attorneys have the same response, it is time to move on with your life.

Sure, you can sue him. You might have some trouble as some time has gone by and your witnesses to the incident have evaporated, but you can certainly contact an attorney.

If this guy doesn't have insurance that covers this type of incident (homeowner's sometimes will extend to owner's stupidity), you can sue him and even win, but never collect one red cent. If this guy doesn't have the ability to pay you, you will never see any money from him. He can ignore the court ordered settlement forcing you to go back to court to get liens and court ordered pay garnishment. At that point he can declare bankruptcy and you get nothing except a bill from your own lawyers which you will have to pay.

Consider this carefully before suing him.
