How long do i have to sue a bike company for personal injury?

Postby siwili » Fri Apr 01, 2011 3:30 am

I was about 10 or 9 its most likely 10 but there was a exercise bike i always use to play on, it's real old i still have it, i think it was made by Schwin. Anyway i was riding the bike one day when i fell off and my finger somehow got caught in between the sprocket and the chain and in the process and it happened so fast that i ripped off my thumb from where the nail starts to grow from the cuticle. There was a safety guard but it did not cover the whole chain and sprocket just the top of chain. I was out of school for 2 months had to eat noodle soup and gushers for 2 months a lot of surgeries and have difficulty doing certain things like tying my shoe, can't go into the military now...iv tried countless of times and it just won't work. Certain days there is sharp pain too so im pretty fed up and now i want to sue but id if its to late, im 17 so that could of happened 7-8 years ago...is it to late?

Usually, it's one year, but you'd have to talk to an attorney in your state. There may be exceptions and the judge might make an exception in your case. But a lawyer is the only one who can tell you.

Laws vary from state to state. Here in Georgia, you have 2 years to file a claim.

Generally speaking this is too long ago, but it depends on when the injury was discovered and when the cause of the injury was realized and again, what state you are in.

Good luck. Let me know if i can help answer any other questions.

Here in Texas, the statute is 2 years, BUT there are exceptions to this. One such exception is in the case of a minor child. In Texas, if you were injured as a child, you have 2 years to bring a lawsuit, starting from the day you turn 18.

Only problem is, as in ALL personal injury cases, the sooner you act, the better your case will be. After a few years, memories turn fuzzy, evidence is lost, etc. Finding an attorney to take on a case this old may be extremely difficult; especially if it is not a case of gross negligence.
