How long does an employer have to adjust your pay rate once you've been promoted?

Postby teithi71 » Sat Oct 29, 2011 2:20 am

Hey everyone. First of all I'm in California (our labor laws are a little wonky) and I was promoted back on August 9th. I know that when you're terminated there's a set amount of days in which your employer has to get your money to you. What about when you've been promoted?

Is there any limit on how long they're allowed to string me along before they adjust my pay rate to what I was promised? Cause it's almost a month now, and while I'm looking forward to the retro check, I'm putting out money for travel that my previous salary isn't covering.

The only time they are required to do it, is when the increase is in writing.
There is no timeline for them to do it, it could be January and still be waiting....
They also don't have to do it retroactively.

yes, the company has to pay within X days when an employee leaves the company in California.
The same rules do not exist for a promotion.

Even in CA, there's no law that says they EVER have to give you a raise unless minimum wage goes up and you'd be below the new minimum. While usually if you get a promotion you also get a raise, there's no law saying you have to get one.
