How would I be able to fight this Driver's License restriction ticket in court?

Postby torin7 » Sat Feb 25, 2012 9:42 am

according to Texas law ,"for the first 12 months, a provisional license holder under the age of 18 may not drive with more than 1 person that is under the age of 21 that is not an immediate family member".

The other day i was pulled over for an expired sticker, the cop noticed my girlfriend in the passenger seat and busted me with the restriction. In the past i have been pulled over with her in the car before and nothing happened. I have also been a passenger in a car with friends that has been pulled over without any consequences. I recently heard a story about one of my friends who was pulled over at midnight with 8+ people in the car and was dealt nothing but a slap on the wrist.

Would i be able to use these examples? Any advice?

You can try to use those instances but I bet the judge won't listen to them as arguments. The larger problem here is why do you keep getting pulled over? Quit breaking the law! Also you have expired registration as well what do you expect to happen.

From the sound of things you don't need to be driving anyway, you are not responsible!

Don't like my answer oh well just telling you how I see it.

This reminds me of a funny story

Criminal "but your honor EVERYBODY was speeding"

Judge: "That may be but we caught YOU!"

Pointing to other bad behavior to justify your own is a sure way to piss off a judge they don't care if a million people broke the law and got away with it it doesn't mean they are going to let you go.
