Driver's License Was Suspended?

Postby cruz50 » Thu Aug 02, 2012 4:52 pm

I've received one ticket in the past 5 years. I got this ticket a few months back, and I payed it immediately so I didn't have to deal with going to court, and extra fees. Apparently on June 6 my license was suspended because I "didn't" pay the ticket. I found out because I got a letter from my insurance yesterday saying it had been canceled because my license had been suspended. So I've been driving around for a month with a suspended license and had no idea. I called the court clerk in the county where I got the ticket and they said it showed up as payed, and that the never sent to DPS any kind of info saying I didn't pay it. But the DPS in my county says that they are lying because if they hadn't sent it then they would have no way of knowing I didn't pay the ticket. This isn't a huge problem since all i have to do is have the court clerk fax a letter saying I payed it. But I'll still have to wait a while for my license to be un-suspended. They said I could even owe fees even though the court clerk I payed my ticket to says it is a mistake on their part. i could even have to get a whole new license.

Is it illegal for the state to suspend my license and let me drive for a month? Is this some kind of trap? What if I had gotten pulled over. I would have then been arrested on the spot. I don't have family or firends here who could have gotten me out either. If I got into an accident I would have gotten a ticket and been liable for damage that could have been done by someone else? How can the law put me in a situation because of no fault of my own and then hold me responsuble?

And another thing is.. How can they suspend my license with no help from me, but now it is my responsibility to get in un-suspended with no help from them when this was clearly some one else's mistake?

A lot of bad things could have come from driving with a suspended license, but i was given no notice for a month. Is this legal. Does the state owe me for fees, and a new license. Should I sue for their irresponsibility? I mean I could have gotten into a lot of trouble over this due to no fault of my own.

And please don't answer by saying well you got the ticket in the first place so you're guilty.. I made a mistake, and I corrected it. No one is perfect. My mistake wasn't a huge deal. i was going 5 over the limit andI took responsibility. I didn't cause someone to drive around illegally for a month.

Can and should I sue?

I understand that you are angry but you are being irrational thinking you can sue. You did not suffer direct harm because of their mistake. You COULD have, but you didn't. Consider yourself lucky and document, document, document your interactions with those that will help you get your license reinstated.

I would challenge any fees by speaking to a supervisor and bringing documentation with you that states that there was a mistake that caused your license to be suspended. Be calm, cool and collected. Provide evidence. If you challenge the fees, it may take longer to get your license so pick your poison.

pare dealing with a decades old system of long time button pushers some of whom dont care about getting the job done right.I have never just blindly dropped a check in the mail for a fine and forgot about it. I went down to where the court house was and payed my fine after they screwed one payment up as a juvenile. After that it was all about drive to the court pay the fine get my reciept.
How yours went on so long before you found out shows how flawed the system really is and your not the only one im sure. Can you sue? not a chance sorrry you may find an attorney who can talk a good story and milk you awhile he first has to go in front of a judge and find out if he can get permission to sue the city. That takes about 10 years. And then if he can it may take another 10 years to get in front of a judge and prove your point.
I have empathy for what you went through and can tell you I have been through much worse than what I briefly explained. I have been arrested for tickets that went into warrants erroneously, and then one year lateer was arrested again for the exact same ticket. Once something goes into cyberspace there is no telling where or when it will come back out. We can only hope the system works long enough that we can live through the nonsence it unnecessarily burdens us with. Is it fair ? NO but short of an all out complete and utter sit down of the sheep refusing to be bullied by a large scum sucking organ with deep pockets that can swallow us whole what can we do ?

Yes you should sue those lazy *** f*cks for wasting your time. They were careless and as a result, you suffered. Probably some fat sh*t didn't wanna get his *** off his donut eating chair and deliver the document. Just make sure you have your evidence & you should win. 1 Speeding ticket isn't even a big deal, especially if you already paid it.

Illegal? No. It is a mistake
What if? could have, might have. They didn't happen so it Doesn't apply
Fair? No but sometimes dumb things happen.

Live with it.
