I've received one ticket in the past 5 years. I got this ticket a few months back, and I payed it immediately so I didn't have to deal with going to court, and extra fees. Apparently on June 6 my license was suspended because I "didn't" pay the ticket. I found out because I got a letter from my insurance yesterday saying it had been canceled because my license had been suspended. So I've been driving around for a month with a suspended license and had no idea. I called the court clerk in the county where I got the ticket and they said it showed up as payed, and that the never sent to DPS any kind of info saying I didn't pay it. But the DPS in my county says that they are lying because if they hadn't sent it then they would have no way of knowing I didn't pay the ticket. This isn't a huge problem since all i have to do is have the court clerk fax a letter saying I payed it. But I'll still have to wait a while for my license to be un-suspended. They said I could even owe fees even though the court clerk I payed my ticket to says it is a mistake on their part. i could even have to get a whole new license.
Is it illegal for the state to suspend my license and let me drive for a month? Is this some kind of trap? What if I had gotten pulled over. I would have then been arrested on the spot. I don't have family or firends here who could have gotten me out either. If I got into an accident I would have gotten a ticket and been liable for damage that could have been done by someone else? How can the law put me in a situation because of no fault of my own and then hold me responsuble?
And another thing is.. How can they suspend my license with no help from me, but now it is my responsibility to get in un-suspended with no help from them when this was clearly some one else's mistake?
A lot of bad things could have come from driving with a suspended license, but i was given no notice for a month. Is this legal. Does the state owe me for fees, and a new license. Should I sue for their irresponsibility? I mean I could have gotten into a lot of trouble over this due to no fault of my own.
And please don't answer by saying well you got the ticket in the first place so you're guilty.. I made a mistake, and I corrected it. No one is perfect. My mistake wasn't a huge deal. i was going 5 over the limit andI took responsibility. I didn't cause someone to drive around illegally for a month.
Can and should I sue?
