You have to do several things before filing ANY suit (including a class action). Have you asked for your money back? Spoken with your bank or CC company? Sent a letter of demand?

Find a real good lawyer who is up for taking such a case.

Also, realize that class actions financially benefit the lawyers far more than they ever do the clients. You get a share of the judgement equal to all other plaintiffs (dozens, hundreds, or thousands...) and the lawyers get a big chunk of everything.
