I am getting sued for damage caused by a mechanic driving my car for a test drive?

Postby fenwick » Tue Jul 24, 2012 4:16 am

Good evening. Thank you for your assistance. We took our car to a mechanic for 60000 miles maintenance. When they test drived the car, they caused an accident and they hit a car and
caused personal injuries to a third party. Now we are being sued because we are the owner of the vehicle involved in the accident. Our insurance will not represent us because
the car was in the possession of a garage and they have their own policy. They told us that the insurance of the garage should provide legal representation even if we are not their
clients. To me, it sounds strange that I would be defended by a party against which I may have future litigation because my car is still not fixed. Is that a standard procedure ?
We are located in Florida. ??

This will probably get thrown out in court because the liability was not yours at the time. They should be suing the mechanic.

Sounds to me like the injured party has an attorney using a shot gun approach and is suing everyone to see what sticks. I don't understand why your own insurance isn't stepping forward for you though.

Do we think you need an attorney? Why would that matter? YOU ARE GETTING SUED. YOU NEED A LAWYER. Cause and effect. Cause and effect. And I would reconsider as to whom you wish to have auto insurance coverage. Your insurance company needs to guide you better on situations like this rather than just walk away. YOU PAY THEM MONEY. Best of luck. Do remember that YOU can also SUE the garage for any damages or payments you may have to make as the result of a court order. Sorry. But a lawyer is your best option.
