There are many legal theories of strict and premises liability. If you want a treatise on the law, go to the library.

Yes. Some person or companies may be held “strictly liable” for certain activities that harm others, even if they have not acted negligently or with wrongful intent. Under this theory, a person injured by a defective or unexpectedly dangerous product, for instance, may recover compensation from the maker or seller of the product without showing that the manufacturer or seller was actually negligent.

Maybe the person was not negligent? Maybe they were reckless? Perhaps your attorney can prove that?

If you know who engaged in behavior that caused you to be injured then what's left to prove? If I engaged in action(s) that caused you injury then I am responsible. A competent attorney will know which legal theory applies.
