I need legal advice and FAST on my workers compensation issue!?

Ok I will be contacting a lawyer tomorrow but I thought I'd get some other views on this issue I have.

I was injured in April 09 at work. I hurt my back and I have been on and off restricted duties ever since. I have since resigned from this job and I have had enough of being in pain at work.

When I resigned the insurance company and my work offered me a $2000 claim settlement. I really feel that this is not near what I am entitled to. I have lost over $3000 in wages by being paid workers comp rates.

I had to give a months notice when resigning and today I received a call from the insurance company and they said that if I want to leave work early to start my new employment I need to sign a form to cease to payments from my employer. I have included below the email that I received in case I explain it incorretly:

As discussed this afternoon, please find attached the Consent to Cease Weekly Wages Form, for your consideration and signature.

I confirm that ******* are prepared to release you from your remaining notice period on the proviso that you sign and return the attached form enabling ******** to cease your current partial incapacity rate of $124.37.

You have confirmed that you will be earning more that your complete wage entitlement of $383.98 gross per week, when you commence your new job with an alternate employer and the above offer will enable you to commence this role sooner.

If you agree to the above, ******* has indicated that they will not be considering paying out any notice period from an internal HR point of view and this can be discussed further with ***********


I honestly feel that this is not right and by me signing this form I will be "screwing" myself as such and that they are forcing me to close my claim 1. I am leaving and 2. they dont want to pay me out my claim.

If I sign this form I will lose any ground for negociating my settlement... HELP PLEASE!!!!!

Get an attorney.....it will be expensive.........
