I need some advice regarding a problem with my house which I bought in 2004.?

I bought my home in 2004 and paid cash at the closing. The closing was held at my attorney's office, the seller received a check for the entire balance of the house. So from there, my closing attorney sent the deed to the wrong address so I never received it to record it so he told me he would try to get the seller to sign another one to transfer the property. The seller refused to sign the new deed. Property taxes all came in the name of the seller between 2004 and 2009 but I paid them all from my own pocket. I was the only one who paid the property taxes.

In early 2009, because the property was still under the seller's name, she sold it again to someone else. The seller and new buyer had a closing by a different attorney, a deed was issued and recorded to the new buyer. Later in 2009 my deed to the property was found and given to me. I recorded my deed.

Now as it is, there are two deeds to this property, one for me and one for the new owner. Property taxes now come in the name of the new owner which I still pay for.

I contacted my attorney for help in 2009 and he said he was looking into it, now it's 2012 and he's supposily still looking into it and has done nothing to remedy the problem.

Since the seller sold my property the second time, I feel that she committed fraud so I called the police and told them what had happened and they say that it's not a criminal matter, just civil. I don't understand this because she sold a property the second time that she didn't even own.

In the meantime, we have been getting eviction notices from the new buyer saying that they want me and my family off the property. The notices are never notarized or delivered by the sheriff, the new buyer delivers the notices herself.

What can I do to remedy the problem and be able to own my property without interferrance from others? My attorney is worthless, can't afford to get a different attorney, legal aid will not handle real estate matters and the police claim there's nothing that I can do to straighten the matter out.

Any suggestions?

Your worthless attorney is the guilty part in this scenario, I suggest you sue him for all that you paid out of pocket. Many lawyers work on a contingency basis, such that if they think you have a good case they will waive their fees until a judgment or settlement can be reached, and then take 1/3 of the award. It is better than nothing.

1 take your lawyer to court for gross negligent (no knowing the properties address of the transaction is just that...also not putting a return address on the envelope again gross negligent.

2 check with your county records in some areas if you pay taxes for 2 or more years in a row then its yours legally.

3 Since the seller did not (he legally has to) see to it you received the deed, its called something

4 also place a lein against the property for all your costs what you paid plus what is legal in your state many is 30% for fee and what ever the average interest on a home loan plus a few % because it wasn't actually a home loan. Once you are absloutly sure its yourse free and clear release your own lein (look up your state "how to place a lein against RE. (this site will help no lawyer to place the lein, but doing so will help motivate the change of deed.

check with your states dept of consumer affairs and those regulatory system as well as HUD
