I am glad..... You had been able to operate factors out with him however a court order clarifies the amounts of responsibility.   If he is paying kid help he ought to be in a position to claim him on the taxes, too.  I heard that many divorced couples claim the kids the way you are suggesting.  Each parent, ever other year.   I would agree if the kid assistance amount is a fair amount. Tell you what, you could go ahead and claim the kid, too. When the IRS notices the conflict, they'd deny both of you and you would then be forced to get your "court order" or some kind of ruling officially settling who gets to claim the deduction. It'd be picking a fight, but one could also say that he picked the fight by filing that way without telling or asking you first.

 ... father paid more than 50% of the child's support.  The IRS doesn't get involved as long as the child is claimed as a dependent only once in any tax year. (There is, iirc, some provision for two people each claiming half, or similar arrangements.)    The fact that there is no court order could make the negotiations awkward -- i hope that you have a lot of supporting receipts, ones that amount to more than double the amount of child support.  By the way, i wonder why the amount of child support doesn't include some amount for medical expenses -- surely no child fails to get sick occasionally.  How is it that there is no court order, yet he pays child support?  If he is paying as much in child support as you are paying per year in other expenses, wouldn't it make sense that the father would feel entitled to split the tax benfits by claiming dependency every other year?   There are lots of issues surrounding your question that i can't pretend to address even-handedly from outside, with so little knowledge of the details of the situation.

You were able to work things out with him however a court order clarifies the amounts of responsibility.   If he is paying child support he should be able to claim him on the taxes, too.  I heard that many divorced couples claim the kids the way you are suggesting.  Each parent, ever other year.   I would agree if the child support amount is a fair amount.
