Im deploying and need to terminate my lease! Am I covered by the Soldiers and Sailors Act?

Postby hyun-su » Thu Oct 27, 2011 4:16 am

Hello there I currently live in Las Vegas, Nevada and will be deploying soon for 6 months....but my rental lease isnt up until November. I heard that Im covered by the Soldiers and sailors act but when I wen on their website it said that I can be only covered before entrance into active duty....but some people are saying otherwise. I also heard that some states have military laws that I can break my lease if im deployed. Does the state of Nevada cover me and could you please include some references to your answers so that it could better help me...Thanks!

You are covered if you were in the military prior to signing the lease, and are being deployed now.

You are not covered if you joined the military after signing the lease, or volunteered for duty.

That's just my understanding though, I may be mistaken.

As a Landord in NJ I have to say these laws are sketchy. But as an American I would certainly excuse a renter from their Lease to enter actice duty -if they let me know up front that this may happen and we are on the same page. I would expect at least 30 days notice and a clean and ready as possible rental returned.

yes you can if you signed your lease before you became active duty if you are reserves, if you are active duty then yes you can with no limitations
