The Obama administration has sued several states for trying to enforce federal immigration laws when the federal government refused to enforce them. The reason is that states do not have the authority to enforce federal law. Clearly Obama is very aware of state versus federal jurisdiction in this case.
But in Obamacare, the federal government makes regulations on insurance, even though insurance is a state regulated industry because the federal government has no authority to regulate insurance.
There is no interstate commerce in insurance. The states and insurance companies make very sure of that. And the Constitution does not specifically give Congress the power to regulate insurance. But Obama seems to be selectively unaware of state versus federal jurisdiction in this case.
Why does Obama have selective amnesia about the jurisdiction issue, depending on how it supports his agenda?
