Is anyone familiar with the OtterBox warranty policy?

I have an iPhone 4 case from the OtterBox commuter series, and the top of the outer plastic layer snapped off. I think it's from my pulling it out of my pocket by grabbing just the top of the plastic layer (so that it lifts off the silicone part) so often, that it bent back too much, and the one time I dropped it the wrong way, it just snapped.

It's only been one month since I bought it, and I know there's a 1 year warranty. I emailed customer service, and they said they'd be willing to replace it, but they asked for a couple of things, one of them being the cause of the damage to the case.

If I tell them what I did, will I still get it replaced? On their site, their warranty policy says,
"Otter Products, LLC and its affiliated companies worldwide (“OtterBox”) warrants our OtterBox products against defects in material or workmanship for a period of one year from the original date of purchase of the product by a consumer (the “Warranty Period”)."
"....If a material or workmanship defect arises with regard to any OtterBox product, and a valid claim is received within the Warranty Period, OtterBox will (i) repair the OtterBox product using new or refurbished parts or (ii) replace the OtterBox product with a new or refurbished OtterBox product."
"Except for the limited warranty expressly set forth above or to the extent restricted or prohibited by applicable law, OtterBox expressly disclaims any and all other warranties express or implied, including any warranty of quality, merchantability, or fitness for a particular purpose, and you specifically agree that OtterBox shall not be liable for any special, incidental, indirect, punitive, or consequential damages for breach of any warranty of any type on this product."

Would my case be considered as " special, incidental, indirect, punitive, or consequential damages"? Because their warranty doesn't cover that... Any suggestions as to what I should tell them happened to my case? Has anyone tried to get their OtterBox replaced before?

My Opinion: Taking it in and out of your pockect is normal and is what the case is designed for. So I would say it is damaged under "norma usage" and not under any special circumstances so I would argue that that is definately something the warranty should cover. And it's only been a month since you have had it.


I think punitive, or consequential damages means they do not cover the iPhone if it got damaged or if you were looking for some type of compensation from them
