Is it Medical Malpractice...?

Postby naseem » Mon Jun 04, 2012 9:52 pm

... If the doctor told my girlfriend to wait a week for sex after the Depo-Provera shot and she got pregnant when the net says to wait two weeks? I know the Internet isn't always trustworthy, but multiple sources say to wait two weeks. If she is pregnant because he gave her wrong information, can we sue for medical bills and cost of raising him/her?

It might be, but I doubt that you'd find any lawyer willing to take take the case.
Obviously, I'm not an expert and this is just a personal opinion.

If you were given wrong answers you can sue for medical bills however you can't sue for the cost of raising a child that alone is the sole responsibility of the parents. Unless harm was caused by the doctor to the baby otherwise. But I doubt that.

Cost of raising the child?

Are you kidding me?

So if she got one set of instructions from doctor and another from the internet - why didn't she go with the internet one? Sometimes people have to take charge of their own lives. And I would guess she was given a paper that listed all the side effects and instructions as well.

Weight gain is one. Want to sue for that too if she gains 15 pounds?

I found a website that says the shot is effective immediately if given within 5 days of the menstrual cycle.

And how about the possibility that the pregnancy occurred before the shot?

And did you guys read where Depo-Provera - and any other form of birth control - is only 99% effective. Nothing is 100%.

Maybe you guys are in that 1%.

I don't see any medical malpractice here. But feel free to fork over thousands of dollars to an attorney to find out.
