Is my landlord allowed to show my apartment to others before I move out?

Postby montrel68 » Wed Apr 06, 2011 6:28 am

I am living in a room in an old schoolhouse that was converted into an apartment building several years ago, and I just gave 30 days notice of my intent to vacate as I am buying a house. The leasing company that administers the building (but who is not the owner of the property) notified me yesterday that they will be showing my apartment to other prospective renters tomorrow, even though I haven't moved out yet. I'm not sure I want to let strangers in my still-occupied apartment--it feels like an invasion of my privacy, and I really don't want to have anything stolen. Is this sort of thing typically allowed under rental laws? (I live in Indiana.) I realize that landlords are allowed to come onto the property for repairs if they give at least 24 hours notice, but showing my apartment to other people while I'm still living here just doesn't feel right. Any idea what the law might be in Indiana that would allow (or prohibit) the leasing company to do this?

There are no laws which prohibit this situation. The landlords are entitled to show the property so that they can have another tenant lined up to move in when you vacate. If you don't want to have the property shown while you are living there, then be prepared to pay an extra month's rent AFTER you move out.

Yes, landlords are allowed to show to potential tenants, even though u haven't move yet. As long as they give you 24 hours notice before coming into your apartment. So you should have all personal items stowed in a safe place or in storage.

Of course he is. He/she is allowed to show the apartment during reasonable hours to find a new tenant. They own "your" apartment. Unless of course you would like to pay rent for the days the apartment stands empty after you move out.

You'll need to check your lease; the terms that they'll start showing the apt. will be in there. But yes, they do have the right, so make sure that you put any valuables and personal items away.

Not just for repairs, but the landlord may come into your apartment for any legitimate reason (including to show it) with 24 hours' notice.

The landlord still has to give you 24 hr notice to show the apartment, every time they show it. I you work you cant be there, and you do not have to give your consent to show it if you are not there. You should check on Indiana landlord tenant law to be sure I am right. Landlords can come for any reason with 24-hour notice. If it is for repairs, they dont need any notice, esp in emergency. It may not feel right, but they have to show it. Put your valuable things away and lock them up.
