Hello, I am renting an apartment in Boston, MA, and just like almost everyone else in the city I am moving into a new place September 1. As you might know Boston is crazy on Sept 1 and the only moving truck we could rent has to be returned by 6 AM on Sept 1, AND I have to work at noon on Sept 1 and really need to move in before then because I'll need to leave my current place for the new tenants to move in. This is not a problem for me, pulling an all-nighter to move is fine, BUT my realtor I was working with told us the current tenant won't be out until noon on Sept 1. Isn't the place legally mine at... midnight? If it is, how can I get the realtor to give me the keys the day before (obviously, the office isn't open at that time..) I hate to be a jerk and kick the tenant out so early but there is really nothing else I can do. Moving in after noon does not work for me. Are there any laws about this? What about laws on when I get keys to my new apartment?
I have tried asking the realtor I rented through but he has been completely, COMPLETELY unresponsive after he cashed my check (imagine that!!!) All he did in response to all my questions was give me the current tenant's email address. Something tells me if I politely ask him to move out by midnight I am going to get shot down...
Any thoughts or advice on my legal rights would be great.
