Is there a law stating that body jewelry cannot be returned?

Postby darce » Wed Dec 14, 2011 8:49 pm

I live in Michigan and have searched online for an answer but short of going to see a lawyer I cant find an answer. I bought "captive" hoop earrings from a mall kiosk, I noticed that they were too small so about an hour after I got them I went back to the kiosk and requested a refund. I was told that it is against Michigan state law to return body jewelry. I was given the run around by the 2 girls working the stand and a manager that spoke to me over the phone. I asked 6 more places that carry they same type of jewelry and it was a 50/50 split as to the law. Some ppl have never heard of it others have. I think its an excuse to not have to return the items. They also never gave me a receipt, and told me that they couldn't open the register to do a return. I filed a report with the mall but was told that I most likely would not get my money back. I would like to know 2 things ..... one is there such a law and 2 should I take this to the BBB? Please help

It's almost certainly a violation of the state's health code...every state I know of doesn't allow it.

Even if there is no law (you can go read the Michigan civil code if you want to know for sure) the store is under no obligation to accept the return anyway. I would argue that even if they can legally accept the return it's good store policy not to - as others have pointed out, it's very unsanitary.

It's body jewelry...they don't know if you have used it or not and that's unsanitary.

When you decide to have any part of your body pierced, remember that this is more than fashion, it involves your health.
