Is there a statute of limitation on warrants for Missouri?

Postby eilis » Sat Apr 02, 2011 3:10 am

My brother in Law from AR got 2 traffic tickets in MO back in 2002 and failed to appear. Warrants were issued in 2002 for failure to appear. Is there a statute of limitations on this? Or can he still be arested 9 years after the fact?

Warrants never expire.

The statute of limitations is determined from the time of the offense until court action is taken. If a warrant is issued, that is considered a court action, so the statute of limitations does not apply.

Unfortunately, no statue of limitations; once a ticket has been issued, you have received official notice of the 'crime.' That eliminates the purpose of a statute of limitations. In most cases, if you failed to appear in court, and haven't paid the fine, the court has found you guilty and recorded the judgment.

Warrants are forever... they only go away after you're arrested or you die.

The Statute of Limitations ONLY applies to the filing of a case in the court...

If a warrant was issued, the case was filed in a timely manner.

In answer to your question, he can be arrested 9, 10 or 25 years after the warrant is issued.

There is NO statute of limitations on warrants ANYWHERE in the U.S.A !!

He can , and WILL , be arrested even 50 years after the fact .......... or longer ! People have been arrested 30 , 40 , even SIXTY years after a warrant was issued for traffic violations !

No.......obviously.
Otherwise every idiot who doesn't want to obey the law or take responsibility for their actions would ignore their warrants.

He can (and will) still be arrested.
And if he was an adult, he'd take care of things now.
