I need a reference to back up what is being said because I am going to talk to my employer and would like to have some laws or substance backing it up, federal or Nebraska state law is preferable.

I get to work, get ready to clock-in and my boss tells me "Don't clock-in yet we may not need you but we need you to stick around in case it gets busy." I stay there for 2 hours most time before they finally send me home, no pay.

I would not care if it was 30 minutes or so but 2 HOURS? really? I already lose 30 mins driving into work. so that's 3 hours of my life and 10 dollars in gas that I waste every time.

I know "I should quit" but I am not a 15 year old that lives with his mother, quitting takes time so I might as well try to hash it out while I can. Thanks in advance!

bring up the gas issue.. legally what they are is somewhat wrong but there is not much you can do about it unless you brought in a lawyer and that would cost money you don't have..

tell your boss (in the best you can) that you really can't afford to come in and not work,, that it is costing you in gas.. tell her don't mind being 'on call' on those days that they might not need you.. if you can afford that also..

you are in a tight spot, while illegal to have you wait around without being paid, if you make a fuss with your dept of labor you will probably end up getting fired for some other reason, so my advice is if jobs are scarce where you are then stick it out until you can find something else, you can file a complaint with your states dept of labor, but reality is it will be your word against your employers
