Lack Of Work During Green Card Procedure

Postby Hedley » Sat May 24, 2014 7:11 am

Our organization moved me towards the Usa on an L1A Credit and also have since decided to recruit my Natural Card. Just a couple of of months before we ultimately posted the request combined with the proper costs.
Today, because of the fiscal conditions, they've chose to shut our division that'll lead to the removal of my placement over the following 60-days, , nor have another placement to move me to?
May this influence the procedure? May I be severed by my organization but still carry on using the Natural Card procedure? May I still get my agreement to function permits and move ahead?
Additionally, I've additional businesses which are currently thinking about employing me. May they recruit my H1B Credit while I'm within the Natural Card procedure?
Finally, if your organization holds my H1B Visa, do they've to employ me? Imagine if they've intention to employ and need to make the most of the April 1st distribution day being simply nearby, however choose to not produce the positioning. Do I still obtain the H1B visa consequently permitting me to get support from another organization, and never have to feel the April 1st procedure again?
Any help with some of this could be greatly appreciated.
Thanks,

Loss Of Job During Green Card Process

You'll have to look for a fresh H1B company to stay in standing. If you do not have one, you've an (casual) ten-day interval to summary your matters and abandon the nation.
We've no method of understanding in case your new company may possibly qualify to recruit you to get a Natural Card, or be thinking about continuing that procedure for you personally. You'd require your work to stay an identical occupational category. But most significant, you'll need your I140 to become authorized before you modify careers, and also to have experienced your I485 pending for 180 times. If that isn't your circumstances, I would recommend asking an immigration attorney about your options.
