In July 2010 I retained a Family Attorney for Child Support because I needed help in getting help with medical cost for my sickly son. I had already amassed $10,000.00 in medical bills for him and needed help and throughout the relationship emailed him about getting future help with medical payments . During my free consult he stated he would also handle my Custody in the same lawsuit since this is day and would cost me around $3500. I gave him a $1500 retainer and made arrangements to pay him monthly. I paid on time in 2010 and then made a lump sum payment in Feb 2011 of $2000.00. We went to court in February 2011 and it was anything but text book. The Master was rude and evil and did not go by the law, so we had to file exceptions. I continue to pay my monthly fee of $100 assuming I had a credit coming when the case was done.
We went to the exceptions hearing in April 2011 and the Judge told the Attorney the reason the Master acted that way was because of my Attorney’s actions. He went on to say my Attorney was in the wrong for telling the Judge the case would only take a few mins to be heard and she did it to make an *** out of him. The Judge agreed the Master was wrong and remanded the case back to the Master to hear the issue. I was upset but happy to get the help I needed for my son. We went to court in June and I got the medical help for my son or so I thought. The Master included my medical cost in the order. I thought I was done right, well wrong. A month later I requested a copy of the support order and when I got it, it did not mention any medical cost.
It seems the Master lumped the amount into the support without making him responsible for future medical bills for our sickly son. I immediately contacted the Attorney and said but you promised me it would be in the order that anything over what I am paying now in medical expenses would be both our responsibility based on our income and he needed to get it fixed because John Hopkins wants to keep him for another medical reason. His response was I will see what I can do, let me know how much it costs you along with sending me a bill for $4,000.00 (which is the 1st time I received an amount of their fees). Well, I did and I did not hear anything back from him so I stopped paying. Since the order, I have been in debt over thousands because of my son’s medical bills and have been considering bankruptcy to keep my home. Of course, now he is taking me to court for the remainder of the his fees.
1. Am I considered behind in my payments since I made the lump sum of $2000.00?
2. Can I countersue him for causing these additional fees, broken promises, and incompetentcy?
3. He never explained there was a cost associated with filing exceptions since it was the state’s fault why wouldn’t they cover the attorney fee’s?
4. Why are my options?
