My boss kept say he has no money to pay me. I worked at restaunt for 5 weeks he never paid me. If I file complain to labor law can I get money from him eventhough he has no money?
contact your labor board or wage/hour board for your state & see what they can do
some states (like Michigan) have good laws & the boards can help you get your pay
other states (like Alabama) have very weak laws & the boards can only send a letter out asking for you to get paid... they have no "teeth" to make it happen
If you are in a weaker state, then you will have to take him to small claims court to get your pay
You will certainly be entitled to money when he gets it, but who is first in line? Breach of contract is illegal though, so you can pursue a legal case against him.
