My mother owns a mobile home in a senior community in California?

She is very disabled and needs constant care around the clock which she cant afford on her fixed income. My husband and myself moved in with her to take care of her, both of us are under 55. The park rules do state one person can live in the home as long as they are over 30. And a caregiver can live in the home as well. The park is trying to say that the one person under 30 has to be the caregiver. This does not seem right to me.
One of the managers came to the door and told me that the eviction process is begining and wouldnt tell me anything else. I am unsure if they want to evict all of us, just myself and my husband. I dont know.
I need to know if this is legal and what I can do. Who are the managers to dictate the kind of care my mother needs and can get.

Ask for, and if necessary, demand, to see the full set of written regulations governing the management of the park. If these regulations aren't already written down, someone is just making them up. You might want to consult an attorney to see what can be done.

The rules would actually depend on your local rent board laws and your mother's lease with the landlord. The first step you need to take is to contact your local rent board and explain your situation to them. They can actually hold hearings to resolve your eviction dispute. In your case, it's a really good idea since eviction is supposedly already under way and there's a legitimate dispute regarding the interpretation of your mom's lease agreement.

You say you and your husband are under 55 but you don't say if you are both over 30 or if one of you is under 30. If one of you is over 30 and the other is the caregiver , I don't see what the problem is EXCEPT if the one of you who would be the caregiver needs to be certified by the state or a program for the work you would be doing.
I don't think the managers are dictating the kind of care your mother needs but they may see you two as family trying to move into the park by way of breaking the rules. You may need to get her doctor in on this and you may need to then qualify as a licensed caregiver.
If the eviction is in the process then you would be receiving paper work spelling all this out and it will not take place on the spot , there will be time to get yourselves straightened out.
They really don't care what people do in the home as long as it is legal but with the eviction notice they have put the ball in your court to prove why you should be allowed to stay according to their rules.

My suggestion is to contact an Elder Care Lawyer..amazing what they can do.
