My previous employer didnt pay, What should I do?

My previous employer didnt pay for the hours I worked. our salary aggrement was on percentage basis 80-20. he filed LCA for 55k and told us that he accumulates that remaining money and gives it to us after every two months. I paid for H1B fee but as per the law employer has to bare the H1B fee. he duducted that H1B expenses from my salary and I have a proof of email conversations with him. he was not paying me correctly so I changed my employer but my previous employer owes me large amount of money as per the 80-20 percentage basis, but now he is saying that I paid you as per the LCA i.e 55K. I have email proof that he aggreed to pay me 80 percent of hourly billing. I sent him emails and called him up many times but I never got reply from him. What Should I do? Can I approach Department of Labor? I can not afford to hire attorney, please suggest me..
