I work for an adult home in new York, we don't have a break room and now our only staff bathroom is being taken away to fill rooms up in the building. My administrator doesn't do anything and expects us to use a residents bathroom. I'd like to file a complaint because that's sickening but I don't know if it's illegal or anything . Can someone help me ?

Work conditions and environment often depends on the size of the facility and number of employees there are. Separate bathrooms and a break room do not necessarily need to be provided. You should check what the requirements are for a company and staff your size. Try searching the Labor Department site: http://www.labor.ny.gov/home/

In my opinion, my friend, this consider a violation a few OSHA regulation in regards to safe work environment. Therefore, the best places to start is with the state's Labor Department.

You can file the complaint with theme to have the places inspected and if DOL's Division of Occupational Safety and Health find in violation, the boss and going to be slapped with a big fine.

Another option will be the federal government. You can try OSHA. They too may be helpful with your case.

In addition, if you have a union, such as Local 1199 of the Service Employees International Union, you can have your union representative go after the administrator in the form of job action or strikes.

Labor laws do not require a break room, or a bathroom designated for employees only. If you don't like the conditions, look for a job somewhere else.
