I know that at the beginning of this country (US), copyright (like patents) was very short (14 yrs I think) and both copyrights and patents were considered government grants rather than forms of property.
I don't think it applied to all artistic works, and it required registration like patents do.
I don't think trademarks existed until later.

As per the title, there is a phrase that a local musician uses but is not currently copywritten (expired in 2007). Would I be able to Trademark the phrase and if so would him using the phrase infringe on my TM or does the fact that he has been using it for some time bypass that?

How long does it take to get an invention patented/trademarked/copywritten and how much does it cost?
